Who we are, the terms of use of the site and our commitments to the brands we support.

This legal notice governs access to, browsing of and use of the website plus-ultra.group. We recommend that you read it carefully: accessing the site implies your full acceptance of it. The terms "we", "+ ULTRA" or "the Company" refer to the owner identified in Article 1.

+ ULTRA carries out its business from its headquarters in Madrid, with a creative studio in Paris and a network of independent experts in London, Milan and the rest of Europe.

2. Definitions

  • Site: the website accessible at plus-ultra.group and all its language versions (Spanish, Portuguese, French and English).
  • User: any natural or legal person who accesses or uses the Site, whether or not they complete a form.
  • Content: the texts, images, photographs, videos, graphics, logos, trade marks, designs, source code and other elements published on the Site.
  • Services: the services provided by + ULTRA as described on the Site (assessment, introduction to buyers, market entry, commercial representation, visibility and administrative formalities), which are provided only under a written contract.
  • Partners: the independent professionals and companies with which + ULTRA works to perform certain Services.

3. Purpose and scope

3.1. The purpose of the Site is to present the business of + ULTRA as a European launch platform for Latin American brands, to provide information about its Services and to enable Users to contact the Company.

3.2. The Site is aimed primarily at professionals and businesses: brands, buyers, institutions and partners. It is not aimed at consumers within the meaning of Real Decreto Legislativo 1/2007, nor at minors.

3.3. This legal notice is supplemented by the Privacy Policy and the Cookie Policy, which form an integral part of the terms of use of the Site.

4. Terms of access and use

4.1. Access to the Site is unrestricted and free of charge, without prejudice to the connection costs of the internet access provider engaged by the User.

4.2. The User undertakes to use the Site and its Content in accordance with the law, good faith, public order and this legal notice. In particular, the User undertakes not to:

  • provide false or inaccurate data, or data belonging to third parties without their consent;
  • introduce or spread viruses, malware or any code that may damage the Site or the systems of + ULTRA or of third parties;
  • attempt to access restricted areas of the Site or its systems, or circumvent its security measures;
  • extract the Content on a large scale or by automated means ("scraping" techniques), unless expressly authorised;
  • use the Site to send unsolicited commercial communications or for unlawful purposes.

4.3. + ULTRA may suspend or restrict access to the Site for any User who breaches these terms, without prejudice to any legal action that may be appropriate.

5. Informational nature of the Content

5.1. The Content is provided for informational and commercial purposes. It is prepared with care and reviewed regularly, but may not at all times reflect the most recent situation.

5.2. No Content constitutes a contractual offer. Each engagement is formalised by means of a written proposal and a contract signed by both parties, which prevail over any information published on the Site. Timescales, deliverables, committed results and financial terms are exclusively those set out in that contract.

5.3. Information relating to European regulations, customs, taxation, product compliance or trade agreements is of a general nature. It does not constitute legal, tax or customs advice and is no substitute for the analysis of each specific case by a qualified professional. Within the scope of its Services, + ULTRA addresses these matters with lawyers and chartered experts from its network.

5.4. The figures, case studies and results presented on the Site relate to specific projects and do not constitute a guarantee of future results, which depend on factors specific to each brand and each market.

6. Intellectual and industrial property

6.1. Site Content

The + ULTRA trade mark, its logos, the graphic design of the Site, its structure, its texts and its source code are owned by [Company name] or are used with the authorisation of their owners, and are protected by Spanish, European and international intellectual and industrial property legislation.

6.2. References and third-party trade marks

The work presented on the References page was produced by our creative studio in Paris and is shown for portfolio purposes. The trade marks, trade names, logos and distinctive signs of third parties appearing on the Site belong to their respective owners. They are mentioned for purely descriptive purposes and their mention does not imply any right over them, nor any association, sponsorship or relationship other than that described.

6.3. Permitted use

The User is authorised to view the Content and to print or download it for personal and internal use, for non-commercial purposes, provided that the reference to its source is retained. Any other reproduction, distribution, communication to the public, transformation or making available, in whole or in part, without the prior written authorisation of + ULTRA is prohibited.

6.4. Notification of infringements

If you consider that any Content on the Site infringes your rights, you may report it to contacto@plus-ultra.group, stating your details, the Content concerned, its location on the Site and evidence of your rights. We will examine the request and, where appropriate, remove the Content with all due diligence.

7. Confidentiality of our clients' information

7.1. Brands that entrust their project to + ULTRA share strategic information: turnover figures, prices, collections, suppliers and launch plans. All such information is treated as strictly confidential.

7.2. To that end, + ULTRA undertakes to:

  • restrict access to the information to the persons working directly on the project;
  • require its collaborators and Partners to comply with an equivalent duty of confidentiality;
  • sign, at the client's request, a specific non-disclosure agreement before any exchange of sensitive information;
  • not publish any project, figure, image or client name without the client's express written authorisation.

7.3. The detailed confidentiality terms applicable to each assignment are set out in the services contract.

8. Network of partners and independent professionals

8.1. For certain assignments (company incorporation, taxation, customs, logistics, trade mark registration, product compliance), + ULTRA coordinates independent professionals and companies, selected for their expertise and reliability.

8.2. Each Partner acts within the scope of its profession, under its own responsibility and subject to its own ethical and legal obligations. The Partners involved in a project are identified in the proposal or in the contract, which specifies the allocation of roles and responsibilities.

9. Liability

9.1. Availability of the Site

+ ULTRA uses all reasonable means to ensure the continuous operation of the Site. However, access may be interrupted by maintenance operations, updates or causes beyond its control. + ULTRA shall not be liable for any loss or damage arising from such interruptions.

9.2. Content

+ ULTRA shall not be liable for decisions taken by the User solely on the basis of the general Content of the Site, without having obtained advice tailored to their situation.

9.3. Security

The Site applies state-of-the-art security measures, including encryption of communications (HTTPS). However, + ULTRA cannot guarantee the complete absence of harmful elements introduced by third parties and recommends that the User keep their own protection systems up to date.

9.4. Limitation

The above exclusions shall not apply in the event of wilful misconduct or gross negligence on the part of + ULTRA, nor in cases where the law does not permit liability to be limited.

10. Links

10.1. Outbound links. The Site may contain links to third-party websites (official bodies, social networks, Partners). + ULTRA does not control those websites and accepts no responsibility for their content, their availability or their privacy policies. In accordance with Article 17 of the LSSI-CE, + ULTRA will promptly remove any link of whose unlawfulness it has actual knowledge.

10.2. Links to the Site. Links to the home page or to the inner pages of the Site are permitted, provided that the link does not suggest a non-existent relationship with + ULTRA, does not reproduce the Content within another website ("framing" techniques) and is not placed on pages with unlawful content or content contrary to the image of + ULTRA.

11. Commercial communications

In accordance with Article 21 of the LSSI-CE, + ULTRA sends commercial communications by electronic means only to those who have expressly requested or authorised them, or to its clients in relation to services similar to those contracted. Each communication includes a simple, free-of-charge procedure for unsubscribing.

12. Personal data protection

Personal data collected through the Site are processed in accordance with Regulation (EU) 2016/679 (GDPR) and Ley Orgánica 3/2018 (LOPDGDD), under the conditions described in the Privacy Policy. The use of cookies and similar technologies is described in the Cookie Policy.

13. Amendments

+ ULTRA may amend this legal notice at any time, as well as the configuration and Content of the Site, in order to adapt them to legislative changes or to the development of its business. The applicable version is the one published at the time of access. The date of the last update appears at the foot of this page.

14. Severability and language

14.1. If any provision of this legal notice is declared null and void or unenforceable, the remaining provisions shall remain in full force and effect.

14.2. This legal notice is published in Spanish, Portuguese, French and English. In the event of any discrepancy between versions, the Spanish version shall prevail.

15. Governing law and jurisdiction

15.1. This legal notice is governed by Spanish law.

15.2. For the resolution of any dispute relating to access to or use of the Site, the parties submit to the courts and tribunals of the city of Madrid, expressly waiving any other jurisdiction, unless a mandatory rule provides otherwise.

15.3. Services contracts entered into with + ULTRA are governed by their own governing law and jurisdiction clauses.
